Terms of Service

1. Acceptance of Terms

Omphalis ("the Service") is operated by Voxiven LLC, 1111B S Governors Ave # 44434, Dover, DE 19904. By accessing or using the Service, you agree to these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time; continued use constitutes acceptance.

2. Description of Service

Omphalis is a comprehension platform that allows users to:

  • Subscribe to and read RSS feeds, newsletters, podcasts, and YouTube channels
  • Save and organize articles, bookmarks, voice notes, meetings, PDFs, and web pages
  • Search saved content with semantic search and surface cross-content connections
  • Listen to saved content via on-demand synthesis
  • Personalize the listening experience with voice and pacing preferences

3. Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining account security.
  • You must be at least 13 years old (16 in the EU).
  • One person or legal entity per account.

4. Plans & Payments

  • Omphalis offers a free plan and paid subscription plans (currently Pro and Premium), billed monthly or annually. Prices are shown on the pricing page and may change with notice.
  • Paid plans renew automatically at the end of each billing period until cancelled. You can cancel at any time; access continues until the end of the current period.
  • Each plan includes a monthly allowance of comprehension units. Included monthly units reset each billing period and do not roll over.
  • You can also purchase one-time unit packages in addition to a plan. Purchased units expire 365 days after purchase.
  • Payments are processed by our payment provider (Stripe). All purchases are final except where a refund is required by law.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Generate audio or other content that impersonates real individuals without consent
  • Upload defamatory, obscene, threatening, or hateful content
  • Circumvent usage limits or access controls
  • Reverse engineer or extract source code
  • Resell synthesized audio as a competing synthesis service
  • Use automated tools without authorization

6. Intellectual Property

  • Your content: You retain full ownership of all text and content you input or save.
  • Generated audio: Licensed to you for personal and commercial use, subject to Omphalis's terms of service. You may NOT resell as a competing synthesis service.
  • Our platform: Omphalis's software, design, and branding are our intellectual property.

7. Privacy

Your use is governed by our Privacy Policy.

8. Service Availability

Omphalis is provided "as is." We do not guarantee uptime. We may modify or discontinue features with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by law, Voxiven LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

10. Termination

  • You may delete your account at any time via account settings.
  • We may suspend accounts that violate these terms.
  • Data deleted per our retention policy.

11. Governing Law

Governed by the laws of the State of Delaware, United States. Disputes shall be resolved in the state and federal courts located in Delaware. EU users retain statutory GDPR rights. California residents retain CCPA rights.
